Electronic Billboard Signs Create New Issues for Florida’s Local Governments
4 months ago
As sign technology evolves, so do the challenges faced by local governments in creating regulations that preserve the health, safety and welfare of their communities. Local regulation of electronic signs is increasingly an issue at the forefront for local governments throughout the state, as approximately 217 digital billboards now populateFloridaroadways, with more proposed.
With constantly-changing displays and bright LED technology, new electronic billboard signs create unique aesthetic and traffic safety concerns. Some sign codes may already prohibit digital signs through bans on animated, flashing or intermittent signage, depending on how those terms are used and defined. Local governments may update their sign regulations to prohibit electronic billboards, and any prohibition or regulation should be carefully considered to ensure that it adequately addresses sign technologies as they evolve over time.
WSH Public Land Use and Zoning Law Group attorneys have assisted numerous local governments in updating their sign regulations to address electronic signs. Recently, Public Land Use and Zoning Law Group Chair Susan L. Trevarthen provided advice for local governments on creating effective regulations of electronic signs, in a December 14, 2011 article in Florida Trend. You can read a copy of the article here.
