On June 6, the 4th DCA affirmed the entry of summary judgment on behalf of WSH client, the City of Deerfield Beach, in a case brought against it by a former City firefighter. In the action, the former firefighter, who had resigned from his City employment, claimed that the City improperly refused to allow him to come back to work after he revoked his resignation before the City provided him with notice of its acceptance of his resignation. The City argued that it had accepted his resignation and processed it (including issuing the firefighter his final paycheck and payouts for accrued leave), and that it was not required as a matter of law to provide the firefighter with a separate formal notice of its acceptance of the firefighter’s resignation. The lower court agreed with the City and entered summary judgment in its favor. The firefighter appealed and the Fourth DCA affirmed the lower court’s decision.
