Managing Director of the Miami-Dade office Mitch Bierman recently spoke with Law360 about preemption cases to keep an eye on in the aviation industry. State and local governments have attempted to create rules governing flight crew wages and benefits, airport operations and crash liability, which have provoked discussions in the aviation industry.
“You might have a situation where the states don’t have any control over making sure that workers in those states have adequate wages,” Mitch told Law360. “Collective bargaining agreements control some of those, but there have been attempts at the state and local level to set responsible wage levels, and there have been attempts by employers to thwart those.”
