In a story published by The Real Deal, Howard D. DuBosar discusses his recent win securing roughly three-quarters of a million dollars in damages from unpaid rent increases. 

“My client is very pleased with the outcome,” Howard said. “They felt very strongly about the language in the lease. The damages are in the neighborhood of three-quarters of a million dollars.”

For the last two years, JP Morgan Chase had refused to pay annual rent increases for a one-story commercial building at 14590 Biscayne Boulevard that it leases from Cypress Property LLC. In defending against a lawsuit filed by the landlord, JP Morgan Chase alleged the company and Cypress Property had agreed that rent hikes would occur every five years. U.S. District Judge Darrin Gayles ruled that the lease requires JP Morgan Chase to pay the landlord’s yearly rent increases.

According to Howard, JP Morgan Chase is on the hook for about roughly $750,000 in unpaid rent increases since 2019. 

While Howard said that the lease’s template is a standard one used by JP Morgan Chase, he believes the bank took an aggressive position, resulting in the loss.

In a recent article by the Daily Business Review, partner, Susan Trevarthen shares her story on becoming a land use attorney. Susan was inspired to pursue urban planning while working as a research assistant under John DeGrove at the Florida Atlantic University-Florida International University Joint Center for Environmental and Urban Problems.

“When you really want to get serious about something happening, you have to translate the plan into actionable items that are enforceable, and that’s where the law comes in,” said Susan. She explains that the “conflict” between preservation and a thriving economy is a “false choice,” as the two actually aren’t mutually exclusive. She sees a middle ground where the two are complementary concepts.

As Chair of the Firm’s Public Sector Land Use and Zoning practice group, Susan serves as town attorney to Lauderdale-by-the-Sea, village attorney for Bal Harbour, and special counsel to various other municipalities, advising on development and zoning regulation, as well as defendings lawsuits filed by developers. Most recently, Susan and her team were the first in South Florida to issue a legal opinion on backing virtual public meetings during the coronavirus pandemic.

Susan is Florida Bar Board Certified in City, County and Local Government Law. She is a graduate of the University of North Carolina School of Law and earned a master’s degree in planning from the University of North Carolina.

Weiss Serota Helfman Cole & Bierman P.L. announces a significant addition to the law firm’s litigation division. Howard DuBosar and The DuBosar Law Group, P.A. joined the firm and are based in its Boca Raton office.

DuBosar and his team bring significant and diverse commercial litigation experience to the firm. Specialty areas include corporate and partnership litigation; business divorce; business torts – including fraud, negligence, and statutory claims; commercial real estate recovery and workouts; bankruptcy litigation; and intellectual property litigation. The group has also represented law firms in numerous partnership and co-counsel disputes.

The team joining Weiss Serota includes Harrison DuBosar, an attorney who focuses on commercial litigation and appellate work, and several longtime employees of The DuBosar Law Group, P.A.

“Howard and Harrison DuBosar’s wide-ranging skillset takes our litigation division and Boca Raton office, which already has a phenomenal group of attorneys, to another level,” said Boca Raton Office Managing Director Brett Schneider. “We are thrilled to welcome them to the Weiss Serota family and know they will add tremendous value to the firm.”

Before launching The DuBosar Law Group, P.A., Howard DuBosar served as partner at Kluger, Peretz, Kaplan & Berlin, P.A. – leading the Miami law firm’s expansion into Boca Raton, and as managing shareholder of the Boca Raton office of Greenberg Traurig, LLP.

“Weiss Serota has a phenomenal culture and I have been impressed with the growth of the Firm,” said DuBosar. “I’ve known for several years the firm’s attorneys and looking forward to working with lawyers across various practice groups,” he added.

DuBosar earned his Juris Doctor from the University of Miami School of Law and a Bachelor of Science from Florida State University.
