Telecommunications/Broadband

Today’s sophisticated telecommunications, broadband cable and internet world demands more than the old “tin can and string” approach. We offer extensive experience and comprehensive knowledge of the laws, regulations and practical concerns pertaining to these fields to assist with contract and regulatory issues.  We have been on the forefront of this area of the law beginning in the 1990s when cell phone towers first dotted the landscape and our telecommunications practice ranges from POTS (plain old telephone service) to PANS (pretty advanced new stuff) and everything in between.

Our practice has evolved to include the representation of governments and private telecommunications providers on all issues from “land line” to advanced wireless.  Our strengths now extend to Internet and broadband issues as well, and our in-depth understanding of the industry’s operations and technology, local, State and Federal regulations and our relationships with State and Federal regulators enable us to provide our clients, whether from the industry, governmental or private side, with the highest level of legal service and advice.

We also prepare ordinances and advise local governments and community associations with respect to issues concerning telecommunication law, wireless service providers and the ever changing technologies.  We represent local governments and private clients with respect to proposals to provide these services, negotiating agreements to locate the required communications equipment and the faculties to provide these services.

We assist public and private clients with the full range of telecommunication/broadband and cable television matters including:

  • Tower Siting
  • Pole Attachment agreements
  • Tower Leasing
  • Litigation
  • FCC Filings and Regulations
  • First Amendment Issues
  • Right of Way Management
  • Franchise Renewals
  • Telecommunications Planning
  • Broadband Systems
  • Internet protocol video
  • Wireless Systems and related ordinances
  • Radio
  • Fiber Optic Telecommunications Networks
  • Pole Attachment Negotiations
  • Public Safety communications

Examples of the types of transactions we have participated include structuring, negotiating and executing:

  • Private bulk service and other agreements with telecom providers on behalf of local governments, homeowners and condominium associations, cooperative associations and developers.
  • Programming and leased access agreements with cable systems on behalf of programmers.
  • Enforcement of Federal “must carry” regulations and retransmission consent arrangements on behalf of programmers seeking carriage on cable systems.

Broadband WiFi, VoIP, DSL, New Technologies and More

As technology continues to evolve, we remain focused on how these technologies impact and create opportunities for private industry and local governments.  We are involved in shaping State and Federal laws that impact the offering of broadband and WiFi services and other new technologies.  We represent local governments and the industry in creating and responding to requests for proposals and negotiating agreement relating to broadband services, including WiFi services, DSL, VoIP, broadband over power lines, or other new technologies, and we are well equipped to advise public and private clients on issues involving competition, compensation, rights of way management, consumer protection, public safety and revenue opportunities.
