Affordable Housing

We have a unique knowledge base and skill set in representing developers of affordable housing, workforce housing, and other publicly-subsidized housing. Mirroring the breadth of our general land use and zoning practice, we can assist with every step of the process from property identification and acquisition, to entitlements, to assisting in the financing process and defending a financing award, to construction and post construction issues. We assist and advise the implementation of these steps, and everything in between, with an eye towards the particular issues facing developers of this type of housing - including achievable densities, parking reductions and waivers, and impact fee waivers and deferrals. Our political contacts at most municipalities and county government informs this effort and enhances the viability of these development efforts.

As part of this representation, we have taken a lead role in re-writing portions of the City of Miami's Miami 21 to benefit and incentivize affordable housing development. This effort demonstrates our strategic thinking – when our clients faced difficulty operating within the confines of regulation, we set out to revise those regulations, and enlisted a multi-faceted approach that included engaging neighborhood representatives, planning staff, and elected officials in our discussions. The result is legislation that the City's Commission can stand proudly behind, while it addresses these issues with the backing of industry proponents and neighborhood activists alike. Win-win scenarios like this are made possible through the efforts and attitudes of our attorneys, that see the opportunities inherent in every problem, think through the potential strategies, and effectuate solutions that benefit our clients in both the long- and short-term.
