The Florida Public Employees Relations Commission (“PERC”) issued a Final Order yesterday dismissing an International Union of Painters and Allied Trades’ unfair labor practice charge against the City of Deerfield Beach. Brett J. Schneider and Raquel Elejabarrieta represented the City in the the unfair labor practice proceeding before PERC.

In the charge, the union alleged that the City unlawfully failed to impact bargain with the union concerning the City’s July 2010 layoff. In its Final Order, PERC confirmed the Hearing Officer’s determination that the union had waived the right to impact bargain with the City over layoffs because the collective bargaining agreement between the parties contains a detailed layoff procedure and a zipper clause that provides that the parties are not obligated to bargain during the term of the agreement over any issue that is addressed in the agreement.
