Representing the Florida Justice Reform Institute and the Florida Trucking Association, firm Member Ed Guedes and Litigation Associate Eric Kay recently filed an amicus curiae brief urging the Florida Supreme Court to adopt in Florida the same summary judgment standard employed in federal courts, as interpreted by the U.S. Supreme Court, and to recede from a 53-year-old Florida precedent that caused Florida’s summary judgment standard to diverge from the federal one. Florida is one of only nine states whose summary judgment standard does not hew to the federal standard, resulting in considerable forum-shopping by litigants.
