Aleida Martínez Molina

Aleida devotes a substantial portion of her practice to representing creditors in a variety of reorganizations and bankruptcies in South Florida and in New York. This experience includes successfully defending preference litigation actions through trial, representing creditors in adversary proceedings to prevent the discharge of amounts owed to them, representing committees of unsecured creditors and otherwise advising non-bankruptcy attorneys in discreet issues relating to bankruptcy actions. She currently serves on the Southern District of Florida Bankruptcy Court Local Rules Committee.
Recent successes in bankruptcy courts include:
- Swift dismissal of foreclosure-eve bankruptcy of a major hotel property on behalf of a bank client;
- Successfully arguing “single asset real estate” provision of Bankruptcy Code on behalf of secured creditor in a $30 Million hotel case;
- Successful opposition of turnover of property to debtor/owner of multi-use commercial property on behalf of creditor client;
- Dismissal of numerous abusive bankruptcy filings of individuals on behalf of condominium association clients; and
- Obtained determination, on behalf of condominium association, of non-dischargeability of post-bankruptcy association fees due from individual debtor/owner to condominium association.
Aleida is also a commercial litigator who represents clients in non-bankruptcy matters in the transportation and hospitality industries, including foreign air carriers, freight forwarders, insurance companies and major hotel franchisees.
Aleida is fully bilingual in Spanish and conversant in French and Brazilian Portuguese, and has substantial experience representing foreign countries and foreign government owned entities in cases brought in the courts of the United States. She has experience litigating Foreign Sovereign Immunities Act, Hague Convention issues and other challenges inherent in matters involving foreign entities. Her experience abroad includes working as a translator (French to English) in Belgium.
